The petitioner apprehends his arrest in connection with Pandaul P.S. Case No.308 of 2020, registered for the offence punishable under Section 366(A) of the Indian Penal Code.

The petitioner is said to have kidnapped the daughter of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the statement of the victim was recorded under Section 164 Cr.P.C. in which she has not supported the prosecution case. It is submitted that the victim girl in her statement recorded under Section 164 Cr.P.C.

Patna High Court CR. MISC. No.70856 of 2021(2) dt.25-07-2022 2/2 states that she being a major girl has herself accompanied the petitioner and has married him (Annexure-2 to this bail application). It is lastly submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application.

Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No.308 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J.) Sanjay/- U T
