2. The accused/petitioner seeks bail in connection with Motihari Cyber P.S. Case No.103 of 2025 registered for the offences punishable under Sections 318(4), 308(2), 316(3), 303(2), 317(2) of the Bhartiya Nyaya Sanhita, 2023 (for short 'B.N.S.') as well as Sections 66-D of the Information and Technology Act.

3. The accused/petitioner is named in the FIR and is in custody since 28.06.2025.

4. Allegation against petitioner is to cheat Rs.55,000/- from informant on false pretext of helping him before police officials in a criminal case.

It is submitted by learned counsel appearing for the petitioner that to save the police officer, on the instance of police, who accepted bribe from this informant, the petitioner has been implicated falsely with present case. It is submitted that the payment as aforesaid was given to police by informant but, as the desired work was not done by police, the present false implication was raised. While concluding argument, it is submitted that investigation of this case is already completed, for which, charge-sheet has been submitted and, as such, there is no chance of tampering with the evidence and moreover petitioner is a man of clean antecedent.

6. Learned APP opposed the prayer for grant of bail to the petitioner.

In view of overall nature of accusation, coupled with the fact that investigation of this case is already completed, where petitioner, being a man of clean antecedent, remains in custody since 28.06.2025, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees
