The petitioner seeks bail in Sadar P.S. Case No. 314 of 2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The petitioner is alleged to have assaulted Ajay Rishi with spade on his head.

Learned counsel for the petitioner submits that the petitioner tried to pacify the quarrel and due to mistake blow was hit on the head of the son of the informant. It is further submitted that from perusal of injury report (Annexure-2), it appears that son of the informant got simple injuries and for that the petitioner is in jail since 03.09.2016.

Considering the facts aforesaid the petitioner above

Patna High Court Cr.Misc. No.11914 of 2017 (2) dt.20-03-2017 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Sadar P.S. Case No. 314 of 2016.
