This application is for grant of bail in connection with Bidupur P.S.Case No.115 of 2016 for the offence under Section 412 of the Indian Penal Code and 25 (1-b)a/26 of the Arms Act. It is submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner and he is in custody since 06.05.2016.

Heard learned A.P.P. also, who has opposed the prayer for bail of the petitioner, stating that four country-made Pistols have been recovered from the house of the petitioner.. Having heard both sides and in view of allegation, as above, I am not inclined to grant bail to the petitioner at this stage, however, as the petitioner is in custody since 06.05.2016, the

Patna High Court Cr.Misc. No.5890 of 2017 (4) dt.21-03-2017 2/2 learned trial court is directed to conduct the trial of the petitioner on day-to-day basis and the S.P., Vaishali at Hajipur is directed to ensure presence of the witnesses in the court on day-to-day basis so that the trial may be concluded within a period of six months, and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court below itself.

With the aforesaid observation, this application is dismissed.
