1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307 and 504/34 of the Indian Penal Code as well as Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 13.05.2024.
4. The informant alleges that on 11.05.2024, at about 08:00 p.m., in the night he had gone to deliver milk in the dairy and when he reached near the maize field Manish Mistri, Harendra Mistri and the petitioner came out of the maize field and Manish Mistri fired causing injury on the waist of the informant while Harendra Mistry fired causing injury on his back and neck and petitioner fired causing injury on his

5. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in the instant case by the informant. It is further submitted that Manish Mistri is son of the informant and Harendra Mistri is own brother of the informant while petitioner is a co-villager and since the petitioner supports Manish Mistri and Harendra Mistri against the informant as such he has been implicated.
6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner and submits that there is specific allegation against this petitioner of firing causing injury on shoulder of the informant.
7. Considering the submissions made by the learned A.P.P., the Court is not inclined to release the petitioner on bail for the present in connection with Sonbarsa Raj P.S. Case No. 76 of 2024 pending in the Court of learned Judicial Magistrate, 1st Class, Saharsa/Successor Court.
8. Hence, prayer for bail is rejected.
