ANJANA MISHRA ORAL ORDER 25-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.09.2018 in connection with S.T. No.376 of 2018 arising out of Kishanpur P.S. Case No.233 of 2018 for the offence under Section 304B of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner has nothing to do with the occurrence. In fact, the girl was found in an unconscious position beside the road and she was taken by the police for medical examination and thereafter she died. It is further submitted that the petitioner was not in the village at that point of time.

Having considered the fact that the petitioner is the

No.55712 of 2019(3) dt.25-09-2019 2/2 husband who has the moral duty to take care of his wife and the death had occurred within seven years of the marriage in connection with the demand of dowry, I am not inclined to grant regular bail to the petitioner. It is, accordingly, rejected. However, the trial of the case may be expedited and be concluded within one year.
