The petitioner is in custody since 28.01.2014 in connection with Kahalgoan P.S. Case No. 39 of 2014 for the offence registered under Sections 302, 201/34 of the Indian Penal Code By the present application, the petitioner has renewed his prayer for bail. However, after perusal of the entire materials on record, it appears that there is no fresh ground so as to consider the case of the petitioner, as earlier the prayer for bail of the petitioner was rejected after due consideration of the facts and materials including whatever was in the case diary. Considering the above facts and circumstances of the case, the prayer for bail of the petitioner is rejected.
Patna High Court Cr.Misc. No.33959 of 2015 (2) dt.19-08-2015 Since the matter is of the year 2014 and till date, charge has not yet been framed, it is hereby directed that the Trial Court proceed forthwith to frame the charge and take appropriate steps for disposing of the trial within a period of 1 year from the date of communication of this order without granting any necessary adjournments.
However, in case, the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail. (Anjana Mishra, J) Jagdish/- U T
