JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case, initially, registered for the offences punishable under Sections 341, 323, 324, 504, 506/34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added.

Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 21.06.2016 passed in Cr. Misc. No. 25460 of 2016 at the initial stage of the case but admittedly, after investigation, police submitted charge sheet for the offences punishable under Section 304 and other minor sections of the Indian Penal Code. Moreover, submission on behalf of the petitioner is that the informant of the present case has

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that alleged occurrence took place on account of land dispute and petitioner is in jail custody for more than one year, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Bhojpur, Ara in connection with Sessions Trial No. 02 of 2017 arising out of Charpokhari P.S. Case No. 285 of 2015.
