Mr.Suman Kumari Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner, informant and learned A.P.P appearing on behalf of the State.

The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 328, 120(B) of the Indian Penal Code and Section 27 Arms Act.

The prosecution case as per F.I.R is that on 15.10.2021, one Chunnu Sharma came to the house of the informant and asked to the son of the informant namely Praduman Kumar to accompany him to visit

Patna High Court CR. MISC. No.62462 of 2022(3) dt.24-03-2023 2/3 Dusshera Mela and thereafter son of the informant did not return to his house. Later on, dead body of the son of the informant was found at Gauri Ghat with firearm injuries. It is alleged by the informant that his son has been murdered in a planned manner by all the accused persons including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is no consistent material evidence against the petitioner and only on the basis of suspicion, the petitioner has been roped in the present case. There is no eye witness to the occurrence. The petitioner is languishing in custody since 27.07.2022.

Learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period

Patna High Court CR. MISC. No.62462 of 2022(3) dt.24-03-2023 3/3 under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 649 of 2021.
