The petitioner apprehends his arrest in connection with R.P.F. Post Narayanpur Anant P.S. Case No. 568 of 2013 registered under Sections 141, 145 and 153 of the Railways Act. The F.I.R. was lodged on the statement of Md. Fulo in which it was alleged that on 29.7.2013 while he was travelling on the train at Dubha railway station, few boys entered into the bogie and stopped the train by vacuum. They made the passengers come down from the train and were assaulted. He too received injury. Contention of the petitioner is that only Vikram has been named in the First Information Report.
Patna High Court Cr.Misc. No.43977 of 2015 (2) dt.13-10-2015 2/2 Learned APP, on the other hand, submits that Vikram made his confessional statement in which he has named the petitioner. The nature of accusation persuades me not to privilege the petitioner with anticipatory bail. The application is dismissed. Let the petitioner surrender in the Court below and seek bail. In that event, the Court Below shall consider the same on its own merit and dispose of in accordance with law unprejudiced by the present order.
