2. The petitioner seeks bail in a case registered for offence under Sections 329(3), 126(2), 115(2), 109(1), 103(1), 352, 351(2), 3(5) of the B.N.S., 2023.
3. As per F.I.R., on 27.03.2025 at about 5 PM, all the accused persons named in the F.I.R. including this petitioner, armed with Lathi, Fatha & iron rod, came at the door of informant and started abusing and on protest by informant's husband, this petitioner assaulted on the neck of informant's husband by means of iron rod, due to which, he fell down on the ground and thereafter, all other accused persons assaulted him and other family members with Lathi-Fatha, as a result of which, during course of treatment, informant's husband died.

Learned counsel for the petitioner submits that as per F.I.R., ten accused persons, including petitioner, assaulted the deceased on his neck & other parts of body, but from perusal of post-mortem report, no external injury has been found on the person of deceased. As a matter of fact, the husband of informant died due to his ailment, but taking benefit of this situation, on account of previous land dispute, petitioner and other persons have been made accused in this case. Petitioner is in custody since 07.06.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Majhauliya P.S. Case No. 185 of 2025.
