The petitioner seeks regular bail in connection with Industrial Police Station Case No. 58 of 2020, registered for the offences punishable under Section 20/22 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

This is the second attempt on behalf of the petitioner for grant of regular bail. Earlier, the prayer for regular bail of the petitioner was rejected by this Court, vide order, dated 25.03.2021, passed in Criminal Misc. No. 4819 of 2021. The allegation, as per the First Information Report, is that 50 kgs. of ganja has been recovered from one ambassador car and one swift dezire car and the petitioner, along with other co-accused person, was arrested from the spot.

No.70730 of 2021(2) dt.22-12-2021 2/2 Learned Counsel for the petitioner, while renewing his prayer for bail, submits that the car, in which the petitioner was sitting, only 15 kgs. of ganja has been recovered. He further submits that the petitioner is in custody since 28.06.2020 and only the charges have been framed.

This Court, after taking into consideration the arguments advanced on behalf of the petitioner had earlier rejected the prayer for bail on its own merits and the petitioner has not brought on record any subsequent development which has taken place in this case for consideration of the present application, except that the charges have been framed against the petitioner in this case, and the recovered ganja is more than the commercial quantity, I am not inclined to grant regular bail to the petitioner.

This application is, accordingly, dismissed.

However, the petitioner may renew his prayer for bail after eighteen (18) months from today if the trial does not show any progress.
