JUSTICE ARUN KUMAR ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the State. Petitioner, who is already in custody, seek bail in Maniyari P.S. Case No.200 of 2016 registered under Sections 399, 402, 414, 120(B) of the Indian Penal Code, Sections 25(1-A), 25 (1-AA), 25 (1-B)a, 26 (ii) and 35 of Arms Act and 20/22 of N.D.P.S. Act.
Allegation in brief is that police apprehended 11 persons after the midnight and out of many recovered loaded country made fire arms, narcotic drugs and miscreants are said to be gang of robbers.
Considering the recovery of loaded fire arms along with two live cartridges in the midnight from possession of the petitioner and recovery of arms from other miscreants, I am not
Patna High Court Cr.Misc. No.5468 of 2017 (3) dt.23-02-2017 2/2 inclined to admit the petitioner on bail at this stage. The prayer for bail of the petitioner is rejected. However, the petitioner may renew his prayer for bail after framing of charge. (Arun Kumar, J) N.H./- U T
