The petitioner apprehends his arrest in Biraul P.S. Case No. 145/2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Vinay Mandal, the informant, named the petitioner along with other accused persons and alleged that the petitioner assaulted the informant with Farsa on his head. When the informant fell down on the ground, Kaushal Kumar Chaudhary also assaulted him with Farsa.

Learned counsel for the petitioner submits that the informant, of course, got two injuries but one injury is on head and another is on left middle finger. Other accused persons have

Patna High Court Cr.Misc. No.10576 of 2017 (2) dt.15-03-2017 2/2 already been granted anticipatory bail. There is a counter version, but from perusal of the injury report as well as the FIR, it appears that the informant made specific allegation against the petitioner that he assaulted on his head and the injury found on his head is opined to be grievous in nature.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
