2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 395, 412, 120B of the Indian Penal Code.
3. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR and petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused Md. Anwar Alam. No incriminating article has been recovered from the conscious possession of the petitioner. Charge sheet has already been filed. Trial court report dated 18.11.2024 reveals that out of 10 charge sheeted witnesses, only one witness has been examined. Petitioner is in custody since 11.3.2019.
4. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.65604 of 2024(4) dt.20-12-2024 2/2 for bail.
5. Considering the aforesaid facts of the case, period of custody and tardy progress of trial, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II, Araria in Forbesganj (Simraha) Police Station Case No. 729 of 2014.
