Patna High Court CWJC No.13553 of 2016 (3) dt.08-05-2018 2/2 petitioner that in view of the statutory provision prescribed under proviso to sub-section (9) of Section 83 of the Waqf Act, 1995 as also in view of the judgment dated 25.04.2018 passed by this Court in the matter of Md. Wasiur Rahman & Anr. vs. State of Bihar (CWJC No. 14622 of 2017), the writ petition challenging the order dated 28.06.2016 passed by the Bihar Waqf Tribunal in Waqf Appeal No.15 of 2013 shall not be maintainable. He submitted that the writ petition may be disposed of with liberty to avail remedy of civil revision.

Leave is granted.
