Petitioner has been granted provisional bail vide order dated 07.06.2022 by this Court.
Learned counsel appearing on behalf of the petitioner submitted that the allegation against the petitioner, is not to deposit merit list and connected documents, as regard to Panchayat teachers selection and appointment, which was of period 2003, 2006 and 2008, whereas, petitioner was appointed only in the year 2016. It is further submitted that the alleged documents were never supplied to this petitioner and this fact has been brought on record by way of affidavit, through Annexure-3 of supplementary affidavit. It is also submitted that the required documents, for which the present prosecution was lodged, has already been deposited by the predecessors of the
Patna High Court CR. MISC. No.71390 of 2021(3) dt.23-08-2022 2/2 petitioner and this fact has also been brought on record through Annexure-2 of the main petition.
In view of the same, the learned counsel advance his request to confirm the provisional bail, as granted earlier by this Court vide order dated 07.06.2022.
Considering the submissions as made above, as petitioner joined service in the year 2016 itself, where documents in issue and merit list has already been deposited by his predecessors, let the provisional bail of the petitioner, above named, be confirmed with the same bailor and sureties, as furnished in furtherance of provisional bail.
