Petitioner apprehends arrest in connection with Tajpur P.S. Case No. (Halai O.P.) No. 371 of 2022 registered for the offence punishable under sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern with the seized article. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.59157 of 2022(3) dt.28-04-2023 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Excise Court 2, Samastipur in connection with Tajpur (Halai OP) Case No. 371 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
