Mr.Rajendra Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 16-10-2023 Heard Mr. Arvind Kumar Singh, learned counsel appearing on behalf of the petitioners and Mr. Rajendra Singh, learned APP for the State.
2. Petitioners seek pre-arrest bail in connection with Aanti P.S.Case No.15 of 2023, registered for the offences punishable under Sections 147, 149, 323, 325, 337, 338, 307, 379, 354, 427, 341,448, 504 and 506 of the Indian Penal Code.
3. Allegation against the petitioners is of commission of assault upon the informant and his family members by means of iron rod, lathi and danda, on account of which, informant side sustained injuries.
4. Learned counsel appearing on behalf of the petitioners submits that allegedly the injuries caused by the
Patna High Court CR. MISC. No.61608 of 2023(2) dt.16-10-2023 2/2 petitioners are found to be simple in nature. There is case and counter case between the parties. Admittedly the occurrence took place due to dispute between the parties over the passage. Petitioners have clean antecedent.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

Having considered the rival submissions of the parties, nature of injuries, which are simple in nature and the other co-accused persons have been granted bail by a Coordinate Bench of this Court, vide order dated 18.08.2023 passed in Cr. Misc. No.51130 of 2023, the petitioners are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri Prashant Kumar Jha, learned J.M. First Class, Gaya in connection with Aanti P.S.Case No.15 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
