====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner, the learned counsel for the informant and learned Additional Public Prosecutor for the state.

The petitioner seeks pre-arrest bail in connection with Karamchat P.S. Case No. 68 of 2018 for the offences alleged under Sections 467, 409 and 34 of the Indian Penal Code. The accusation is that informant, Jitan Kumar Gupta, being the Ward Commissioner of Ward No. 3, issued the cheque of Rs.85,000/- in the name of Laxman Singh of Laxman Traders, brother of the petitioner, to supply the materials for construction of drain between the house of Lalan Ram and graveyard, but, Laxman Singh made manipulation in cheque by putting one "zero" after Rs.85,000/-. Further allegation is that Laxman Singh, brother of the petitioner also withdrew

Patna High Court CR. MISC. No.57838 of 2019(2) dt.13-09-2019 2/2 Rs.6,45,000/- by putting false signature of the informant. The submission of the learned counsel for the petitioner is that petitioner, being the brother of Laxman Singh, has falsely been implicated in this case without any specific allegation.

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Karamchat P.S. Case No. 68 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VII, Kaimur at Bhabhua, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
