JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-11-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant.
2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 61(2), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. Informant suspects that all the named accused persons including this petitioner committed murder of his son because of old animosity. It is alleged that two days prior to the occurrence, this petitioner had threatened informant to kill his son.
4. Learned counsel for the petitioner submits that from perusal of F.I.R., it is apparent that informant is not eyewitness to the occurrence and he has raised suspicion against
Patna High Court CR. MISC. No.59261 of 2025(3) dt.20-11-2025 2/2 this petitioner due to old animosity. No material has come during course of investigation to show complicity of this petitioner in the alleged offence. Petitioner is in custody since 12.06.2025. Chargesheet has been submitted.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Mali P.S. Case No. 124 of 2025.
