The present petition has been filed for quashing of the First Information Report of Danapur P.S. Case No. 241 of 2013, dated 20.05.2013, which has been registered under Sections 341 and 323/34 of the Indian Penal Code. The allegations in the F.I.R. disclosed a minor assault between the parties. Since the occurrence is of the year 2013 and the case was registered in the same year, it is quite likely that the investigation may have been concluded. Since there is no representation on behalf of the petitioners, this Court only directs that in case the investigation has not been completed, the same ought to be completed within a period of three months from the date of receipt/production of a copy of this order.
While concluding the investigation, the Investigating Officer of this case shall take into account that the occurrence is seven years old and that it only involves minor assault between the parties.
With the aforesaid observation/direction, the petition stands disposed off.
