The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 22.06.2016 passed in Cri. Misc. No. 7263 of 2016, on the ground that the petitioner is suffering in custody since 27.08.2015 and due to land dispute the petitioner and others have been implicated. Co-accused Shailesh Kumar and Bigan Kumar @ Jitendra Kumar have been allowed bail and, as such, the petitioner deserves sympathetic consideration.

Learned APP duly assisted by the learned counsel for the informant opposes the prayer of bail by submitting that the

Patna High Court Cr.Misc. No.10823 of 2017 (2) dt.15-03-2017 2/2 petitioner and co-accused Ranjet Kumar shot Mahesh Singh, the brother of the informant, causing his death, In the postmortem report also two fire arm entry wound have been found on vital part of the deceased.

In the facts and circumstances stated above, considering that the petitioner is one of the assailant and, as such, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. (Jitendra Mohan Sharma, J.) Rajiv/- U T
