The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2021, charge-sheet has been submitted in the case and has antecedent of three cases and allegation is of looting bank of Rs. 14,42,170/- by six unknown criminals and they even looted some customers. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and his name came in the confessional statement of co-accused Rakesh Singh @ Rakesh Kumar. It is further submitted that petitioner was neither put on T.I.P. nor any incriminating article connecting him with the offence was recovered from his possession. Learned

Patna High Court CR. MISC. No.70719 of 2021(2) dt.05-05-2022 2/2 counsel further submits that co-accused Rakesh Singh @ Rakesh Kumar on whose confessional statement name of the petitioner transpired has been granted bail vide order dated 18.04.2022 passed in Cr. Misc. No. 70329 of 2021.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.06.2021, charge-sheet has been submitted and the charges have been framed, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Nardiganj P.S. Case No. 40 of 2021 with a condition that one of the bailors of the petitioner shall be his wife, Nilu Devi and further the petitioner will have to appear on day to day basis in the trial and in the event, if the petitioner does not appear on two consecutive dates, the learned court below shall forthwith cancel his bail bonds.
