====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 22.06.2019 in a case for the offence registered under Sections 457 and 380 of the IPC.

The prosecution story, in brief, is that on 28.02.2019, some unknown thieves have committed theft in his Flat No. 103, K.R. Enclave, after breaking the lock. He found that one Almirah was badly damaged and stolen away two silver coins of 25-25 grams and two golden coins of 10 gram and 5 gram. Theft was also committed in 'Shiv Sunila Apartment' of Flat No. 101 and stolen away the articles about Rs. 25-30 thousand including ornaments.

It has been submitted by learned counsel for the

Patna High Court CR. MISC. No.56713 of 2019(2) dt.06-09-2019 2/2 petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no recovery of any incriminating article from possession of the petitioner. The petitioner has not been put on T.I. Parade.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. She has got criminal antecedent.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- II, Danapur, in connection with Rupaspur P.S. Case No. 108/2019.
