The petitioner seeks bail in Sirdala P.S. Case No. 129 of 2021, registered for the offence punishable under Sections 302, 34 of the Indian Penal Code.

As per the FIR, this informant raised suspicion that this petitioner along with other FIR named accused persons committed murder of his son. It is further alleged that daughterin-law of the informant did not like his son and therefore, they committed the alleged occurrence.

It is submitted on behalf of the petitioner that petitioner is none else than father-in-law of the deceased and only on suspicion he has been made accused in this case. There is no eye-witness of the occurrence. As a matter of fact, there

Patna High Court CR. MISC. No.70755 of 2021(3) dt.25-04-2022 2/2 was some quarrel between the wife and husband (deceased) in the night and thereafter, son of informant committed suicide. After the occurrence, this petitioner gave information to the informant and his family members, but after seeing the dead body of his son, informant became furious and falsely implicated this petitioner and others. Petitioner is in custody since 05.09.2021 having no criminal antecedent. Counsel for informant however, vehemently opposed the prayer for bail and submitted that dead body of the victim was found in the house of petitioner and the deceased has died due to strangulation.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
