====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-09-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Bhabua (Sonhan) P.S. Case No. 339 of 2019, registered under Sections 147, 148, 149, 323, 332, 337, 307, 353 and 504 of the Indian Penal Code.

The accusation is that in course of investigation of Mohaniya P.S. Case No. 234 of 2019 registered on 29.05.2019 under Section 395 of the Indian Penal Code, the informant along with other police personnel reached at the house of suspect, Munna Mallah of village Bagacha and started to search him then Munna Mallah and his

Patna High Court CR. MISC. No.56889 of 2019(2) dt.09-09-2019 2/2 wife started to abuse and cause assault to the police party through lathi and danda. In the meantime, Munna Mallah caused injury at the head of informant through Khanti. At that time, 24 persons named in the F.I.R. including the petitioners and 30 to 40 unknown having lathi, danda, bricks and stones came there and caused injury to the police party.

Learned counsel for the petitioners submits that while petitioners are named in the F.I.R. but no specific overt act has been attributed against them. The petitioners, who are lady, have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua, Kaimur, in connection with Bhabua (Sonhan) P.S. Case No. 339 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
