ANJANA PRAKASH ORAL JUDGMENT Date: 20-07-2015 It has been submitted that the value of the truck is Rs.7.5 lacs and, therefore, the requirement of indemnity bond of Rs.20 lacs by the court below is unreasonable.

Considering the aforesaid, the order dated 22.6.2015 passed by the Sub Divisional Judicial Magistrate, Jhanjharpur in Phulparas P.S. case No.129 of 2015 (G.R. No.649 of 2015) in regard to the indemnity bond of Rs.20 lacs for release of truck bearing registration No. WB-11B/7105 is hereby set aside. The court below is directed to consider the value of the truck and fix the bond appropriate and also a reliable surety instead of insisting on a local one and pass a fresh order within a period of two weeks from the date of receipt of this order.
