The petitioner is in custody since 20.12.2013 in connection with Bihta P.S.Case No. 370 of 2013 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

His prayer for bail was earlier rejected by this Court vide order dated 27.11.2014 passed in Cr.Misc. No. 42728 of 2014 and order dated 02.03.2016 passed in Cr.Misc. No. 10112 of 2016. It is contended by the learned counsel for the petitioner that by now except one prosecution witness, all other witnesses have been examined.

Regard being had to the seriousness of the offence and the advance stage of trial, I am not inclined to reconsider the

Patna High Court Cr.Misc. No.8792 of 2017 (2) dt.08-03-2017 2/2 bail application of the petitioner on merits. Accordingly, the application is rejected.
