====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 21-01-2025 Upon repeated calls, no one appears on behalf of the petitioner however, Learned Counsel for State is present.

2. Though, No one appeared on behalf of the petitioner. As such, this Court hereby appoints Mr. Arvind Kumar, Advocate as amicus curiae in this case.

3. Learned Counsel for the State submits that soft copy of the counter-affidavit has already been filed and he requested to file hard copy of the counter-affidavit in the Court itself.

4. Permission granted.

5. Since this matter is very old (of the year 2018) and

Patna High Court CWJC No.9682 of 2018(5) dt.21-01-2025 2/3 as per the pleadings, it is being intimated that the grievances of the petitioner have already been settled.

6. Learned amicus curiae submits that the present writ petition has been filed directing the respondents to implement the order No.41011-01759 dated 20.06.2017 and order No.51011-01333 dated 29.03.2017 filed by respondent Nos. 3 and 4 i.e., for reconstruction/repairing of the road Abadpur to Palasi as raw material has been lying near the road since long and the Officials had not taken steps for completion of the said construction.

7. Learned amicus curiae further submits that the State has filed a counter-affidavit and by the counter-affidavit, it transpires that the grievances of the petitioner have been settled and the said construction as demanded, has already been completed.

8. Counsel for the State also submits that from the pleading, it transpires that the grievances of the petitioner have settled.

9. In the light of the submissions and particularly the submissions made in paragraph 7 of the counter-affidavit which are as follows:- "That pursuant to the aforesaid order,

Patna High Court CWJC No.9682 of 2018(5) dt.21-01-2025 3/3 the present respondent department invited Notice inviting tender for reconstruction and repairing of the road namely Abadpur to Palasi under FDR.

2245 scheme of the department and following the process of tender, finally the reconstruction and and repairing work was allotted to the successful bidder namely Ranjan Engicon Pvt. Ltd. Vide agreement dated 19.01.2019 as per which the date of commencement of the work was 19.01.2019 and the date of completion of the work was fixed as on 18.01.2020."

10. Learned amicus curiae shall be entitled to remuneration as per Notification dated 16.05.2017 published in Bihar Gazette on 18.05.2017 to be paid by the Patna High Court Legal Services Committee.

11. As such, it transpires to this Court that grievances of the petitioner has been fulfilled. Hence, the present writ petition stands disposed off.
