2. The petitioner is in custody since 24.11.2016 in connection with Kurhani P.S. Case No. 380 of 2016 for the alleged offences under Sections 414, 464, 34 of the Indian Penal Code and Sections 205 and 206 of the M.V.Act.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of a motor cycle said to have been made from the petitioner in course of routine checking by the police.

4. Having regard to the nature of accusations and gravity of the offence alleged as well as recovery of the motor cycle said to have been made from the conscious possession of the
