The petitioner is languishing in custody since 1.2.2019 in a case registered for the offences punishable under Sections 384 and 386/34 of the I.P.C., Sections 25(1-B) a, 26,37 and 35 of the Arms Act and Section 37(c) of the Bihar Prohibition of Excise Act, 2016.

It is alleged that on 30.1.2019, the petitioner in inebriated condition entered into the house of the informant armed with pistol and demanded extortion. Subsequently, the arms recovered from the petitioner were handed over to the police. It is submitted by learned counsel for the petitioner that in the background of previous enmity, the accusation has been levelled against the petitioner. It is further submitted that no substantial injury has been caused to any one. Though the petitioner is accused in one other

Learned APP submits that specific accusation has been levelled against the petitioner.

Considering the nature of accusation, the investigation being concluded and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge, Excise Act, Bhagalpur in connection with Habibpur P.S.
