JUSTICE SANJAY PRIYA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khagaria P.S. case No. 122 of 2016, G.R. No. 386 of 2016 instituted for the offence under Sections 363, 365 and 34 of the Indian Penal Code. It is alleged that the petitioner along with other accused persons has taken the son of the informant namely Neeraj Kumar aged about 17 years old to Munger. The petitioner and other accused persons as named in the written report returned but the son of the informant did not return.
It has been submitted on behalf of the petitioner that mere suspicion has been raised against the petitioner in the written report as well as in the case diary. The investigation has been completed and charge sheet has been submitted for the offence
Patna High Court Cr.Misc. No.3065 of 2017 (3) dt.23-02-2017 2/2 under Sections 363 and 365/34 of the Indian Penal Code. The learned A.P.P. has pointed out various paragraphs of the case diary wherein mere suspicion has been raised against the petitioner. The witnesses have alleged that son of the informant has gone with this petitioner. The petitioner is said to be in custody since 28.8.2016.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd, Khagaria, in connection with Khagaria P.S. Case No. 122 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
