2. In the present case, the petitioner seeks bail in connection with Jadopur P.S. Case No. 193 of 2022 registered for the offences under Sections 304(B)/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. As per prosecution case, sister of the informant was married with co-accused Suresh Yadav and allegation against the petitioner and other co-accused is that due to non-fulfillment of dowry demand, sister of the informant was strangulated to death.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner is neither the husband
Patna High Court CR. MISC. No.60664 of 2025(2) dt.08-09-2025 2/3 of the deceased nor the family member of the deceased. Petitioner has no concern with the family affairs of the deceased and his house is separate from the deceased and his family. Earlier the petitioner was granted anticipatory bail by a Coordinate Bench of this Court vide order dated 26.06.2024 passed in Cr. Misc. No. 33420 of 2024 with a condition to surrender within four weeks before the court below. Further vide order dated 20.06.2025 passed in Cr. Misc. No. 27551 of 2025, six weeks' time was granted to the petitioner to surrender before the court below. Though the petitioner has complied the order dated 20.06.2025 passed in Cr. Misc. No. 27551 of 2025, his bail was rejected by the court concerned. There is general and omnibus allegation against the petitioner and other co-accused persons. There is no specific allegation against the petitioner for doing any overt act. Petitioner is in custody since 09.07.2025 and he is having clean antecedent.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the distant relationship of the petitioner with the deceased and also considering the clean antecedent of the petitioner along with his

No.60664 of 2025(2) dt.08-09-2025 3/3 period of custody, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned ADJ-1, Gopalganj/concerned court in connection with Jadpour P.S. Case No. 193 of 2022, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
