This is a petition for grant of regular bail for offence under Section 302/34 of the Indian Penal Code. According to first information report, the petitioner and two others caused death of Sunny Kumar by assaulting him and penetrating a tube light in his anus. The post mortem report supports the prosecution allegation of the manner and the nature of the injury. Submission of the petitioner is that witnesses examined by the police vide paragraphs 6 and 7 of the case diary would reveal that the tube light was not in the hand of this petitioner though the allegation was heinous one, but, there is no material against the petitioner to substantiate. The petitioner is in custody since 05.10.2016.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner
Patna High Court Cr.Misc. No.8613 of 2017 (3) dt.21-03-2017 2/2 on bail.
The prayer for bail is refused.
The learned trial Court is directed to expedite the trial.
