The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 188 and 504 of the Indian Penal Code.
It is a case of defying the government order passed by the appropriate Court but in spite of that the petitioner started digging the land which was prohibited by the informant, upon which the petitioner started beating by fist and slaps and also abused to the informant.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is land dispute between the parties and there is no specific allegation against this petitioner and the
Patna High Court CR. MISC. No.70953 of 2021(3) dt.20-07-2022 2/2 nature of injury is simple. Petitioner has got clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar, Judicial Magistrate, Ist Class, Madhubani in connection with Khajauli P.S. Case No. 152 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
