The petitioner, already in custody, seeks bail in connection with Kahalgaon (Ghogha) P.S.Case No. 359 of 2016 registered under Sections 366A and 384/34 of the Indian penal Code.

Allegation in brief is that this petitioner enticed away the minor girl of the informant.

Submission is that the girl is major and both had love affairs and eloped and later on returned back and there is no allegation levelled by the girl that she was raped by the petitioner and according to the medical report also, her age is below 18 years which is approximately of the same age and the FIR was lodged after five days of the alleged occurrence and the petitioner has

Patna High Court Cr.Misc. No.6122 of 2017 (4) dt.09-03-2017 2/2 been in custody since 14.11.2016.

Having considered the aforesaid facts and circumstances, the petitioner, namely Prabhat Kumar Paswan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Kahalgaon (Ghogha) P.S.
