JUSTICE SANJAY PRIYA ORAL ORDER 2/ 04-02-2017 Heard Janki Nandan Prasad, learned counsel for the petitioner and the learned A.P.P. for the State. The Petitioner seeks bail in Kotwali P.S. Case No. 634 of 2016 instituted for the offence under Section(s) 385, 387 Indian Penal Code.

It has been alleged that threat was given on the mobile of the informant making demand of ransom of rupees twenty lacs for the last three days. The informant is a heart patient and is suffering from depression. His son is in job at Mumbai. He is under fear.

From the impugned order, it appears that the name of this petitioner has been disclosed by co-accused, Md. Shah Alam, whose confessional statement has been recorded in para 61 of the

Patna High Court Cr.Misc. No.3040 of 2017 (2) dt.04-02-2017 2/2 case diary. The petitioner is not named in the First Information Report. He is in custody since 01.12.2016 having no criminal antecedents.

In the facts and circumstances of the case, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali P.S. Case No.634 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
