The petitioner seeks bail in a case registered under Sections 354(A), 504, 34 of the Indian Penal Code and Section8 of POCSO Act. Allegedly, while the informant was going to attend call of nature, the petitioner caught the hand of the informant with bad intention.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-08-2019. The petitioner has been falsely implicated in the present case. Allegation against the petitioner is of catching the hand of the victim. Except for

Patna High Court CR. MISC. No.55973 of 2019(2) dt.09-09-2019 2/2 this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Madhepura in connection with POCSO Case No. 39 of 2019 arising out of Kumarkhand P.S. Case No. 114 of 2019.
