2. The petitioner apprehends his arrest in connection with Jhanjharpur P.S. Case no.51 of 2022 registered under sections 420, 406 and 34 of the Indian Penal Code.

3. The allegations in the F.I.R is that the accused persons deceived the informant by making false promise of loan and extracted money from her.

4. Learned counsel for the petitioner submits that from the bare reading of F.I.R it would be evident that the allegations are specific against other accused persons whereas petitioner is not named in the F.I.R. His name has transpired during course of investigation on the confessional statement of co-accused Anita Devi. Besides this, no material has come to

Patna High Court CR. MISC. No.62764 of 2025(2) dt.15-09-2025 2/2 connect the petitioner in the alleged crime. The petitioner has no criminal antecedent and undertakes to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Taking into consideration the aforesaid facts of the case and also considering the fact that the petitioner has neither been named in the F.I.R nor any cogent material has transpired against him and similarly situated co-accused has already been granted anticipatory bail vide order dated 17.04.2025 passed in Cr. Misc. No. 80618 of 2024, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Jhanjharpur P.S. Case no.51 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/ successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
