The petitioner is in custody since 14.07.2019 in connection with Sadar P.S. Case No. 454/2019 registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the recovery has been made from the truck and not from the conscious possession of the petitioner and the petitioner has nothing to do with the aforementioned truck. It is further submitted that in one other case of the year 2017 having similar nature, the petitioner has already been extended the privilege of bail.

Case No. 454/2019.
