The petitioner seeks bail in Mahua P.S. Case No. 346 of 2012, corresponding to Sessions Trial No. 400/2013 + 252/2014 and 247/2014, registered under Sections 304(B) and 201/34 of the Indian Penal Code.
The father of the deceased alleged that his daughter was married to the petitioner in the year 2005 and thereafter, the petitioner and other in-laws of her daughter began to demand dowry. His daughter was killed on 13.08.2012 and her dead body was cremated.
It is submitted by learned counsel for the petitioner that the informant participated in cremation of his daughter. The wife of the petitioner was suffering from different ailments and she was
Patna High Court Cr.Misc. No.39686 of 2014 (10) dt.17-04-201 2 / 25 under treatment since the year 2009. The deceased died leaving behind her three children. The informant did not ever complained of any ill-treatment before death of his daughter. F.I.R. was lodged after three days of occurrence. The petitioner is in jail for last two years.
Considering the facts that the petitioner is of course the husband of the deceased but the deceased was ill and medical prescriptions for her treatment were also filed and the petitioner is in jail for last two years, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Ist Additional Sessions Judge, Vaishali at Hajipur in Mahua P.S.
