JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-09-2016 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier dismissed by order dated 05.01.2016 as not pressed vide Cri. Misc. No. 40064 of 2015, on the ground that the trial is not likely to be concluded in near future and the petitioner is suffering in custody since 01.07.2015 and the occurrence has taken place due to land dispute.

Learned APP opposes the prayer of bail by submitting that the petitioner is the assailant and from the report of learned trial Judge, it reveals that the trial is in progress, two prosecution witnesses have already been examined and it is likely to be concluded within eight months.

No.35726 of 2016 (3) dt.21-09-2016 2/2 In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, the learned trial court is directed to expedite the trial and conclude the same preferably within eight months taking all positive steps.
