JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Gopalganj Town P.S. Case No. 348 of 2016, registered under Sections 328, 304, 120-B/34 of the Indian Penal Code and Section 50(A)(B)(C) of Bihar Excise Amendment Act, 2016. The accusation is that informant being the Police Inspector, Sadar Circle, Gopalganj received information that some persons have been admitted in Sadar Hospital, Gopalganj. Thereafter, he reached at Sadar Hospital, where he came to know that six persons died due to taking of poisonous liquor, whereas Vinod Singh and Bhuteli have been referred to Gorakhpur for treatment. On inquiry, Bandhu Ram disclosed that he had taken liquor to the house of Nagina Pasi in village Khajurbani, P.S.

Patna High Court Cr.Misc. No.7328 of 2017 (3) dt.30-03-2017 2/2 Gopalganj. He also disclosed that 14 persons named in the F.I.R., including the petitioner, of village Khajurbani are engaged in preparing and selling of illicit liquor. Learned counsel for the petitioner submits that it would appear from the F.I.R. that it has only come against the petitioner and 13 others that they are engaged in selling of illicit liquor. In fact, petitioner is the mother of co-accused Rajesh Choudhary, who used to sell the liquor and due to that reason, the petitioner has also been implicated in this case and the petitioner, who is lady having no criminal antecedent is in custody since 19.09.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S.
