The petitioner has filed this application against his conviction dated 18.07.2007 passed by the 7th Additional Sessions Jude, Bhagalpur in Cr. Appeal No. 83 of 2000/01/2004 by which he has affirmed the judgment dated 19.09.2000 passed by the Judicial Magistrate 1st Class, Bhagalpur in G.R. No. 02 of 1998, Tr. No. 302 of 2000 arising out of Nathnagar P.S. Case No. 2 of 1998.

It appears that the appellant was convicted for two years under Section 365/34 IPC and one year under Section 120B IPC and was directed to pay a fine of Rs. 2000/- each and in default of which further imprisonment for two months.

From the petition filed herein, it appears that the

Patna High Court CR. REV. No.100 of 2013 (7) dt.23-02-2015 2/2 petitioner was in custody between 04.01.1998 to 21.11.1998 and again from 13.09.2012 to till date. Evidently in such circumstances, he has undergone the entire period of sentence and thus this application has become infructuous. It is dismissed as such.

The Court below shall release the petitioner if he has not already been released on account of pendency of this revision application.
