A deliberate mischief seems to have been played by the then Circle Officer, Kalyanpur introducing the date of retirement as 30th April, 2012 instead of 31st July, 2012. That date of retirement is evident from Annexure-1 and 2 as well as the service book entry. For five years the petitioner's claim for settlement of all his post retirement dues has not begotten him any relief and even after filing of the writ application there seems to be lack of cooperation and promptitude being shown on behalf of the respondents particularly the Circle Officer, Kalyanpur. The writ is disposed of with a direction upon Circle
Patna High Court CWJC No.16150 of 2014 (7) dt.13-07-2017 2/2 Officer, Kalyanpur that all left over dues of the petitioner especially the gratuity and earned leave must be authorized and paid within a period of three months from the date of production of a copy of this order. Non-compliance of the direction will entail consequences upon the said Circle Officer. Whatever approval or direction is required from the superiors must also be taken within the same time.
