On 24.02.2023, no one had appeared and the following order was passed.
"No one appears on behalf of the petitioner, on call.
Learned Senior Counsel for the Economic Offence Unit has taken to this Court to the report no. 3 dated 09.07.2018 sent by the Special Vigilance, Patna (Trap Cases), Patna by which it was informed that statement of accused under Section 313 of the Cr.P.C. was taken on 13.03.2018. However, from 3.04.2018 to 21.04.18, 10.05.18, 06.06.18 and 05.07.18 dates were fixed
Patna High Court CR. MISC. No.38130 of 2015(5) dt.03-03-2023 2/2 for defence witness but they have not concluded the evidence. The next date for defence evidence was fixed on 21.07.2018.
In the aforesaid background, learned Senior Counsel submits that probably the trial may have concluded and so the petitioner has lost interest in the case and as such no one appeared and thus the petition be dismissed.
As a last chance, list this case case after one week. On the said date, if no one appears on behalf of the petitioner, an appropriate order will be passed."
In view of the clear stand of the learned Sessions Judge, another view is not required. However, it seems that the petitioner has lost interest in the matter.
Accordingly, the application is dismissed for want of non-prosecution with liberty to raise all the points before the Trial Court at an appropriate stage.
