This is an application for bail in connection with Forbesganj (Simraha) P.S.Case No. 581 of 2016 registered for the offences punishable under Sections 452, 341, 323, 327, 436, 504 and 324/34 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is of setting the house on fire causing burn injury on the son of the informant.
It has been submitted on behalf of the petitioner that in spite of the direction of this Court a report has been sent by the court concerned and the petitioner is in custody since 3.11.2016. It has further been submitted that there is general and omnibus allegation against the petitioner.
Heard learned APP also, who could not controvert the above submission.
Having heard both sides and from perusal of the record it appears that earlier a report was called for as to whether the injured was examined by any doctor and if there is any injury
Patna High Court Cr.Misc. No.9867 of 2017 (5) dt.01-05-2017 2/2 report in connection with this case but no such injury report is received and considering the aforesaid facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Forbesganj (Simraha) P.S.Case No. 581 of 2016, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail.
