The petitioner seeks bail in Samastipur (M) P.S. case No. 31 of 2017 under Section 414 of the Indian Penal Code and under Section 25(1-b) a, 26, 35 of Arms Act.

The police apprehended the petitioner and one Lakshman Kumar Sahni with a motor cycle. On search, one live cartridge was recovered from the possession of the petitioner. From the possession of Lakshman Kumar Sahni one six round country made pistol and one live cartridge were recovered. It is submitted that no stolen article was recovered from the possession of the petitioner. Lakshman Kuamr Sahni is owner of the motor cycle.

Considering the facts that only one live cartridge was

No.10934 of 2017 (3) dt.24-03-2017 2/2 recovered from the possession of the petitioner, petitioner is in jail for two months and petitioner has got no criminal antecedent, as mentioned in paragraph 3 of the petition, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Samastipur in Samastipur (M) P.S. Case No. 31 of 2017.
