ANSHUMAN ORAL ORDER 25-01-2023 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Jai Prakash University. Counsel for the petitioner submits that the present writ application has been filed for payment of gratuity, group insurance with interest, arrears of difference of salary and benefits of 7th pay revision has not been paid to the petitioner. Counsel for the petitioner submits that petitioner was retired from service from the post of Professor of P.G. Department of Sanskrit on 30.04.2018 but promoted on the post of Professor w.e.f. 08.02.1995. He further submits that after filing this representation as well as several representation, no decision has taken by the University as yet. Counsel for the petitioner submits

Patna High Court CWJC No.15282 of 2022(2) dt.25-01-2023 2/2 that a direction may be given for disposal of his present representation.

Counsel for the University submits that the said representation which is annexed as Annexure-2 has been written in extremely brief manner. He may be directed to file a fresh representation in full detail as to what he has been paid and what are due.

In this background, petitioner is directed to file a fresh representation with all detail that what he has been paid and what are due according to him within 4 weeks from the date of passing of this order and the University is directed to pass a reasoned order on the said representation within 10 weeks thereafter. If found payable assure the payment to the petitioner within 8 weeks thereafter and if not found payable, then pass a reasoned order and communicate to petitioner.

Petitioner shall also be at liberty to challenge the same before appropriate forum.

With this direction, the writ application is hereby disposed off.
